2026 Federal Hemp Law — Section 781 Summary

The standard replaces a plant-level THC percentage test with a total THC cap measured per finished container, counting delta-9 THC, THCA, delta-8, delta-10, and other isomers together. Converted cannabinoids (delta-8, delta-10, HHC, THCP, THC-O) are excluded from the legal hemp definition even when derived from naturally occurring compounds, if produced via chemical conversion.

Devils Lips was built for this standard from the ground up: every product is CBD isolate with 0.00% THC by formulation, not by a percentage that happens to fall under a limit.

We chose isolate specifically because it removes ambiguity: zero THC, maximum compliance headroom, and a consistent consumer safety profile across every strength we sell — from a 500mg tincture to a 2500mg tincture.

Our Testing Plan

No products have shipped yet, so no batch has been tested. Before any batch ships, it will be tested by an independent third-party lab for: cannabinoid profile (confirming CBD content and total THC), pesticides, heavy metals, and microbials. Results will be published per batch — use our Verify a COA tool once real inventory ships.

Every ingredient is listed on every product, no exceptions. See our full Ingredients page. We never use synthetic cannabinoids.

State-by-State Compliance

We plan to ship only to states where our products are compliant, and we will require age verification (18+) nationwide. See our Age Verification Policy for state-specific requirements.

For Retail Partners

We haven't shipped a product yet, so our documentation package doesn't exist today. Before we open for wholesale orders, it will include: a Certificate of Analysis for every product batch, Supplement Facts panels, a compliance declaration letter, and third-party lab accreditation documentation.

Is Devils Lips federally compliant?

Every product is formulated as CBD isolate targeting 0.00% THC, designed to meet the federal hemp standard's total-THC-per-container cap (P.L. 119-37 §781) taking effect November 12, 2026. No products have shipped yet, so no batch has been independently tested.

Do you provide documentation for retail partners?

We will — a full compliance documentation package (COAs, Supplement Facts, compliance declaration letter, lab accreditation) will be available before we open for wholesale orders. It doesn't exist yet because no products have shipped.

Do you sell delta-8 or other converted cannabinoids?

No. Devils Lips never sells delta-8, delta-10, HHC, THCP, THC-O, or any other converted cannabinoid.
